Con motivo de conmemorarse el Día de la Madre, la secretaría de Defensa del Consumidor, María Pía Saravia, brindó una serie de recomendaciones a tener en cuenta al momento de comprar el regalo para mamá, en un local comercial o vía internet.
Compras presenciales
Se deberá tener en cuenta que el precio del producto deberá estar exhibido en vidriera y en el interior del local, por lo que corresponderá cobrar el precio exhibido (aunque sea irrisorio), caso contrario el consumidor deberá tomar una fotografía y dejar constancia en el libro de quejas. El procedimiento será idéntico si no se respeta una promoción.
Por otra parte, está prohibido hacer diferencia de precios entre el pago de contado efectivo, con tarjeta de débito o de crédito en un solo pago. Tampoco se podrá exigir una compra mínima para utilizar la tarjeta de débito o crédito.
El organismo recomienda conservar el ticket y exigir uno de cambio; también es importante que la comunidad se interiorice sobre las modalidades de cambio. Los consumidores deben recordar que el comerciante no puede limitar los horarios y reducir los días de cambio; los usuarios podrán hacerlo en cualquier momento del horario comercial.
Si se compra un artefacto eléctrico, se deberá realizar una prueba en el lugar de compra. Los consumidores deberán informarse sobre las políticas de cambio directo en caso de falla, específicamente la cantidad de días que tienen para hacerlo.
Compras Digitales
Lo más importante es la seguridad para evitar el fraude electrónico. En esta línea el organismo provincial recomienda hacer las compras en sitios seguros teniendo en cuenta que los más denunciados son los sitios de venta por Facebook e Instagram ya que, por la gran demanda de regalos para la fecha, se crean perfiles falsos en las redes sociales.
Para comprobar la seguridad de la web, el mismo debe comenzar siempre con https:// y se debe observar un candado en la parte superior de la página. También se debe verificar la reputación del vendedor, que debe tener un color verde para una valoración positiva. Se recomienda leer los comentarios antes de comprar.
Para una mayor seguridad, los compradores deberán contar con una captura de pantalla, una imagen o fotografía de la promoción para que en caso de existir diferencias con el producto ofertado o incumplimiento de promoción, se pueda reclamar con pruebas fehacientes.
En caso de que la entrega tenga gastos extras como seguros o fletes, se deben elegir empresas de transporte con prestigio. Antes de ofertar se debe consultar si el producto tiene stock disponible y no avanzar en caso de que el mismo esté agotado.
Se deberá establecer una fecha de entrega del producto por escrito, ya sea por mail o el chat del sitio de compra. Todas las pruebas deben guardarse para realizar la denuncia en caso de que la empresa no cumpla con lo pactado. En este sentido, siempre se debe exigir ticket o factura, ya que el mismo se constituye como principal prueba de la compra y es necesario para cualquier reclamo.
Derecho al arrepentimiento
Si al momento de recibir el producto, este no cumple con las expectativas, el mismo podrá devolverse, contando 10 días a partir de la fecha de entrega, dejando constancia por escrito del rechazo y poniendo a disposición el producto sin uso para que lo retiren del domicilio; los gastos extras corren por cuenta de la empresa. Actualmente, los sitios web cuentan con el “botón de arrepentimiento” para desestimar la compra.
Garantías: todos los productos tienen una garantía mínima de 6 meses por ley. En caso de fallas, durante ese lapso, el consumidor tiene derecho a la reparación gratuita y a un servicio técnico adecuado incluyendo los costos de flete en cualquier punto del país.
Finalmente los consumidores podrán realizar su reclamo ante la empresa proveedora y en caso de no obtener respuestas satisfactorias, podrán realizar su denuncia mediante la plataforma digital de Defensa del Consumidor ingresando en: www.salta.gov.ar/defensadelconsumidor
